Terms of Service for the Zabota App

Effective date: January 1, 2025

1. General Provisions and Definitions

These Terms of Service (hereinafter referred to as the "Terms") govern the relationship between the user of the Zabota mobile application (hereinafter referred to as the "App") and the individual entrepreneur, TIN (INN) 771385639022 (hereinafter referred to as the "Operator").

Definitions used:

  • Caregiver: a registered user of the App who monitors one or more loved ones.
  • Loved One: a person who is being monitored through the App, typically an elderly relative.
  • Operator: an individual entrepreneur, TIN (INN) 771385639022, providing services through the App.
  • Subscription: a paid service providing access to monitoring features for each loved one.
  • Incident: an event recorded in the App that requires the caregiver's attention or a response from the operator call center (fall, emergency call, route deviation, etc.).

2. Registration and Account

To use the App, you must register and create an account. By registering, you agree to:

  • Be at least 18 years of age.
  • Provide accurate and current personal information (name, phone number, email address).
  • Maintain only one account per person.
  • Ensure the security of your account: do not share your login credentials with third parties and use a strong password.
  • Immediately notify the Operator of any unauthorized access to your account.

You bear full responsibility for all actions performed using your account.

3. Service Description

The Zabota App provides the following services:

  • Geolocation monitoring: real-time tracking of the loved one's location on the map using GPS data from their device.
  • Check-in: a system of regular wellness confirmations from the loved one. The caregiver receives a notification if a check-in is missed.
  • Incident system: recording and processing of events related to the loved one. Incidents are forwarded to call center operators for timely response.
  • Push notifications: instant notifications about events related to loved ones (missed check-ins, incidents, status updates) via the OneSignal service.
  • Activity log: a complete history of actions and events related to loved ones, available within the App.

4. Subscription and Payment

  • Payment model: a subscription is issued separately for each loved one. The subscription price is listed in the App and may be changed by the Operator with prior notice.
  • Trial period: each new loved one receives a free trial period of 30 days. All App features are available during the trial period.
  • Payment methods: payments are processed through the payment providers CloudPayments and YooKassa. The Operator does not store users' bank card details.
  • Automatic renewal: the subscription is automatically renewed at the end of the paid period unless the user cancels it before the current period expires.
  • Refund policy: the user may request a refund within 14 days of payment, provided that the services have not been fully utilized. To request a refund, please contact our support team at support@zabota.app.

5. User Obligations

The user agrees to:

  • Use the App exclusively for lawful purposes and in accordance with these Terms.
  • Obtain the informed consent of the monitored person (or their legal representative) for monitoring their location and other data through the App.
  • Provide accurate and truthful information during registration and throughout the use of the App.
  • Not reverse engineer, decompile, disassemble, or otherwise interfere with the App's source code.
  • Not use the App to surveil individuals without their knowledge and consent.
  • Not attempt unauthorized access to servers, databases, or other users' accounts.

6. Service Limitations

The Zabota App is NOT a replacement for emergency services (112/103). In case of a threat to life or health, you must immediately contact the appropriate emergency services.

The user acknowledges the following limitations:

  • GPS accuracy: location accuracy depends on the technical characteristics of the loved one's device, environmental conditions (indoors, dense urban areas), and the availability of satellite signals. The Operator does not guarantee absolute accuracy of geolocation data.
  • Network dependency: the App requires a stable internet connection to function. Connectivity disruptions may result in delays in receiving location data and notifications.
  • Service availability: the Operator strives to ensure uninterrupted operation of the App but does not guarantee the absence of technical failures, maintenance downtimes, or force majeure circumstances.

7. Limitation of Liability

The App is provided on an "as is" basis. The Operator makes no warranties, express or implied, regarding the uninterrupted or error-free operation of the App.

  • The Operator is not liable for the actions or inactions of users, nor for consequences resulting from the use or inability to use the App.
  • The Operator is not liable for damage caused by inaccurate geolocation data, delays in notification delivery, or service unavailability.
  • The Operator's aggregate liability to the user is limited to the amount of payments actually made by the user in the 3 (three) months preceding the event giving rise to the claim.

8. Intellectual Property

All rights to the App, including but not limited to the source code, interface design, trademarks, logos, text, and graphic materials, belong to the Operator or are used by the Operator on lawful grounds.

The user is granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. Any copying, distribution, modification, or other use of the App's materials without the written consent of the Operator is prohibited.

9. Termination

  • Account deletion by the user: the user may delete their account at any time through the "Settings" section of the App. Upon account deletion, all data will be removed in accordance with the Privacy Policy.
  • Account suspension by the Operator: the Operator may suspend or block a user's account in case of violation of these Terms, use of the App for unlawful purposes, suspected fraud, or systematic abuse of the service. The user will be notified of the suspension via email.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Russian Federation. All disputes arising out of or in connection with these Terms shall be submitted to the courts at the Operator's location, unless otherwise provided by applicable law.
